Puede limitarse el importe frente al que responde, los conceptos y su duraci\u00f3n, debi\u00e9ndose especificar si debe responder durante toda la vigencia del contrato o se incluyen tambi\u00e9n sus prorrogas.<\/p>\n<p>En caso de no establecerse limitaci\u00f3n en el contrato de arrendamiento, se entender\u00e1 que el avalista responde frente a todas las obligaciones contra\u00eddas en el contrato por parte del arrendatario.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Derechos del avalista<\/strong><\/p>\n<p>El avalista o fiador tiene derechos que puede oponer frente al arrendador:<\/p>\n<p>&#8211; <strong>Derecho de orden.<\/strong> El arrendador primero dirigirse al arrendatario para exigir el cumplimiento de sus obligaciones y solo despu\u00e9s podr\u00e1 dirigirse contra el avalista.<\/p>\n<p>&#8211; <strong>Beneficio de excusi\u00f3n.<\/strong> Mediante el que se obliga al arrendador a dirigirse primero contra los bienes del arrendatario y solo en caso de no disponer o no cubrir la cantidad reclamada, poder embargar los bienes del avalista.<\/p>\n<p>&#8211; <strong>Derecho de divisi\u00f3n.<\/strong> En caso de que haya varios fiadores, la deuda se reparte entre todos en partes iguales o de acuerdo con los porcentajes que se establezcan, salvo que se haya pactado la solidaridad entre ellos.<\/p>\n<p>El avalista podr\u00e1 hacer valer estos derechos si no ha renunciado de forma expresa a los mismos en el contrato de arrendamiento, en tal caso se podr\u00e1 dirigir el arrendador directamente contra el avalista y sus bienes sin necesidad de hacerlo previamente contra el arrendatario.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Avalista y seguro de alquiler<\/strong><\/p>\n<p>Si vas a contratar un seguro de Alquiler, debes saber que en las p\u00f3lizas de ARAG Alquiler se admite la posibilidad de incluir un avalista si solamente con el inquilino no se puede aprobar el estudio de solvencia.
