Estas cl\u00e1usulas ser\u00e1n consideradas nulas y no se aplicar\u00e1n, aunque las hayamos firmado como inquilinos.<\/p>\n<p>Explicamos algunas de las m\u00e1s comunes:<\/p>\n<ul>\n<li><strong>Pr\u00f3rroga legal del contrato<\/strong>. La ley establece que la duraci\u00f3n del contrato ser\u00e1 pactada por las partes, pero si es inferior a un a\u00f1o, el contrato se prorrogar\u00e1 de a\u00f1o en a\u00f1o hasta llegar a los 5 a\u00f1os. La posibilidad de prorrogar el contrato es una potestad del inquilino, no del propietario, y no se podr\u00e1 pactar lo contrario.<\/li>\n<li><strong>Obligado cumplimiento del contrato.<\/strong> Como inquilinos tenemos derecho a rescindir el contrato una vez hayan transcurrido los 6 primeros meses, siempre y cuando hayamos avisado con un mes de antelaci\u00f3n. En este caso, el propietario tendr\u00e1 derecho a reclamarnos una indemnizaci\u00f3n de un mes de renta por a\u00f1o que quede de cumplir el contrato, y si queda menos de un a\u00f1o, la parte proporcional. El derecho a indemnizaci\u00f3n debe estar pactado en contrato.<\/li>\n<li><strong>Falsos arrendamientos de temporada.<\/strong> Aunque en contrato se establezca que es de temporada (eso significa que no es la vivienda permanente del inquilino), si podemos demostrar que no es cierto y que es nuestra vivienda habitual, tendremos derecho a que la duraci\u00f3n del contrato sea por 5 a\u00f1os.<\/li>\n<li><strong>Deber de conservaci\u00f3n de la vivienda.<\/strong> La obligaci\u00f3n de mantener la vivienda en buen estado de uso para que sea habitable es siempre del propietario y no ser\u00e1 v\u00e1lido trasladarle la obligaci\u00f3n al inquilino, que s\u00f3lo debe hacerse cargo de las peque\u00f1as reparaciones por uso.<\/li>\n<li><strong>Acceso del arrendador a la vivienda.<\/strong> Ser\u00e1 nula la cl\u00e1usula por la que se obligue al inquilino a dejar entrar en la vivienda al arrendador para poder revisar su estado.<\/li>\n<\/ul>\n<p>Por todo este tipo de problemas, ARAG ha creado ARAG inquilinos. El seguro es una p\u00f3liza adaptada a los arrendatarios que alquilan una vivienda. El seguro protege los derechos e intereses del inquilino y su contrato de alquiler de vivienda habitual.
