{"id":20673,"date":"2024-12-09T18:42:20","date_gmt":"2024-12-09T16:42:20","guid":{"rendered":"https:\/\/www.elcol-legi.org\/w\/nota-asesoria-laboral-03-2024\/"},"modified":"2024-12-12T04:01:22","modified_gmt":"2024-12-12T02:01:22","slug":"nota-asesoria-laboral-03-2024","status":"publish","type":"post","link":"https:\/\/www.elcol-legi.org\/w\/es\/nota-asesoria-laboral-03-2024\/","title":{"rendered":"Protocolo de seguridad ante el acoso sexual"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><p>[vc_row][vc_column width=&#8221;3\/4&#8243;][vc_column_text css=&#8221;&#8221;]<\/p>\n<pre>Legislaci\u00f3n<\/pre>\n<h2><b>Protocolo de seguridad ante el acoso sexual<\/b><\/h2>\n<p>[\/vc_column_text][stm_spacing lg_spacing=&#8221;6&#8243; md_spacing=&#8221;6&#8243; sm_spacing=&#8221;6&#8243; xs_spacing=&#8221;6&#8243;][vc_column_text css=&#8221;&#8221;]<strong>La ley obliga a disponer de una operativa estricta ante posibles abusos por raz\u00f3n de sexo<\/strong>[\/vc_column_text][vc_single_image source=&#8221;featured_image&#8221; img_size=&#8221;850&#215;350&#8243;][vc_column_text css=&#8221;.vc_custom_1733968875796{margin-bottom: 20px !important;}&#8221;]Las personas trabajadoras tienen derecho a una protecci\u00f3n eficaz en materia de seguridad y salud en el trabajo y, el empresario, en este caso de la corredur\u00eda, tiene la correlativa obligaci\u00f3n de protecci\u00f3n de sus personas trabajadoras frente a los riesgos laborales, debiendo garantizar su seguridad y salud en todos los aspectos relacionados con el trabajo.<\/p>\n<p>En el marco de estas responsabilidades, el empresario debe realizar la prevenci\u00f3n de los riesgos laborales mediante la integraci\u00f3n de la actividad preventiva en la empresa y la adopci\u00f3n de cuantas medidas sean necesarias, para la protecci\u00f3n de la seguridad y la salud de las personas a su servicio y debe tambi\u00e9n desarrollar una acci\u00f3n permanente de\u00a0<b>seguimiento de la actividad preventiva,\u00a0<\/b>con el fin de perfeccionar de manera continua las actividades de identificaci\u00f3n, evaluaci\u00f3n y control de los riesgos que no se hayan podido evitar y los niveles de protecci\u00f3n existentes, arbitrando cuanto sea necesario para la adaptaci\u00f3n de las medidas de prevenci\u00f3n a las variaciones que puedan experimentar las circunstancias de la prestaci\u00f3n laboral.<\/p>\n<p>Una de las concretas obligaciones en esta gen\u00e9rica obligaci\u00f3n de todo empresario de velar por la salud y la seguridad de sus personas trabajadoras es la de disponer de un protocolo para la prevenci\u00f3n y actuaci\u00f3n frente al acoso sexual y el acoso por raz\u00f3n de sexo, que debe satisfacer la necesidad de prevenir, sensibilizar y, en su caso, atajar con todas las garant\u00edas estas formas de violencia y discriminaci\u00f3n en el \u00e1mbito laboral.
