A esta acci\u00f3n la llamamos desheredaci\u00f3n y, para poder hacerlo, se debe expresar en testamento, siempre y cuando concurran las causas que establece la ley.<\/p>\n<p><strong>\u00bfCu\u00e1les son las causas para desheredar?<\/strong><\/p>\n<p>&#8211; La Ley establece que son justas causas para desheredar a un hijo las siguientes:<\/p>\n<p>&#8211; Haber negado alimentos al progenitor o ascendiente que lo deshereda.<\/p>\n<p>&#8211; Por maltrato de obra o haber injuriado gravemente de palabra al progenitor o ascendiente.<\/p>\n<p>&#8211; Ser condenado por sentencia firme por haber cometido un delito contra los derechos y deberes familiares sobre la herencia del causante.<\/p>\n<p>&#8211; Por haber acusado falsamente al causante de un delito grave.<\/p>\n<p>&#8211; Haber obligado a hacer testamento o cambiarlo bajo amenaza, fraude o violencia.<\/p>\n<p>&#8211; Haber impedido hacer testamento, revocarlo, suplantar, ocultar o alterar otro posterior.<\/p>\n<p><strong>\u00bfPuede el desheredado impugnar el testamento?<\/strong><\/p>\n<p>Si el desheredado no est\u00e1 de acuerdo con que se le haya privado de la herencia podr\u00e1 interponer una demanda ante los Tribunales. La demanda ir\u00e1 dirigida contra los herederos del causante, debiendo ser \u00e9stos quien prueben que efectivamente el desheredado caus\u00f3 un da\u00f1o al testador.<\/p>\n<p><strong>\u00bfQu\u00e9 sucede si me reconcilio el desheredado?<\/strong><\/p>\n<p>Si finalmente existe una reconciliaci\u00f3n, habr\u00e1 que manifestarlo en escritura p\u00fablica.
