Pot limitar-se l&#8217;import enfront del qual respon, els conceptes i la seva durada, havent-se d&#8217;especificar si ha de respondre durant tota la vig\u00e8ncia del contracte o s&#8217;inclouen tamb\u00e9 els seus prorrogues.<\/p>\n<p>En cas de no establir-se limitaci\u00f3 en el contracte d&#8217;arrendament, s&#8217;entendr\u00e0 que l&#8217;avalador respon enfront de totes les obligacions contretes en el contracte per part de l&#8217;arrendatari.<\/p>\n<p><strong>Drets de l&#8217;avalador<\/strong><\/p>\n<p>L&#8217;avalador o fiador t\u00e9 drets que pot oposar enfront de l&#8217;arrendador:<\/p>\n<p>&#8211; <strong>Dret d&#8217;ordre.<\/strong> L&#8217;arrendador primer dirigir-se a l&#8217;arrendatari per a exigir el compliment de les seves obligacions i nom\u00e9s despr\u00e9s podr\u00e0 dirigir-se contra l&#8217;avalador.<\/p>\n<p>&#8211; <strong>Benefici d&#8217;excussi\u00f3.<\/strong> Mitjan\u00e7ant el qual s&#8217;obliga l&#8217;arrendador a dirigir-se primer contra els b\u00e9ns de l&#8217;arrendatari i solo en cas de no disposar o no cobrir la quantitat reclamada, poder embargar els b\u00e9ns de l&#8217;avalador.<\/p>\n<p>&#8211; <strong>Dret de divisi\u00f3.<\/strong> En cas que hi hagi diversos fiadors, el deute es reparteix entre tots en parts iguals o d&#8217;acord amb els percentatges que s&#8217;estableixin, tret que s&#8217;hagi pactat la solidaritat entre ells.<\/p>\n<p>L&#8217;avalador podr\u00e0 fer valer aquests drets si no ha renunciat de manera expressa als mateixos en el contracte d&#8217;arrendament, en tal cas es podr\u00e0 dirigir l&#8217;arrendador directament contra l&#8217;avalador i els seus b\u00e9ns sense necessitat de fer-ho pr\u00e8viament contra l&#8217;arrendatari.<\/p>\n<p><strong>Avalador i asseguran\u00e7a de lloguer<br \/>\n<\/strong>Si contractar\u00e0s una asseguran\u00e7a de Lloguer, has de saber que en les p\u00f2lisses d&#8217;ARAG Lloguer s&#8217;admet la possibilitat d&#8217;incloure un avalador si solament amb l&#8217;inquil\u00ed no es pot aprovar l&#8217;estudi de solv\u00e8ncia.
