Aquestes cl\u00e0usules seran considerades nul\u00b7les i no s&#8217;aplicaran, encara que les h\u00e0gim signat com a llogaters.<\/p>\n<p>Expliquem algunes de les m\u00e9s comunes:<\/p>\n<ul>\n<li><strong>Pr\u00f2rroga legal del contracte<\/strong>. La llei estableix que la durada del contracte ser\u00e0 pactada per les parts, per\u00f2 si \u00e9s inferior a un any, el contracte es prorrogar\u00e0 cada any fins arribar als 5 anys. La possibilitat de prorrogar el contracte \u00e9s una potestat de l&#8217;inquil\u00ed, no del propietari, i no es podr\u00e0 pactar el contrari.<\/li>\n<li><strong>Obligat compliment del contracte<\/strong>. Com a llogaters tenim dret a rescindir el contracte un cop hagin transcorregut els 6 primers mesos, sempre que h\u00e0gim avisat amb un mes d&#8217;antelaci\u00f3. En aquest cas, el propietari tindr\u00e0 dret a reclamar-nos una indemnitzaci\u00f3 d\u2019un mes de renda per any que quedi de complir el contracte, i si queda menys d\u2019un any, la part proporcional. El dret a indemnitzaci\u00f3 ha d&#8217;estar pactat en contracte.<\/li>\n<li><strong>Falsos arrendaments de temporada<\/strong>. Tot i que en contracte s&#8217;estableixi que \u00e9s de temporada (aix\u00f2 vol dir que no \u00e9s l&#8217;habitatge permanent de l&#8217;inquil\u00ed), si podem demostrar que no \u00e9s cert i que \u00e9s el nostre habitatge habitual, tindrem dret que la durada del contracte sigui per 5 anys.<\/li>\n<li><strong>Deure de conservaci\u00f3 de l&#8217;habitatge<\/strong>. L&#8217;obligaci\u00f3 de mantenir l&#8217;habitatge en bon estat d&#8217;\u00fas perqu\u00e8 sigui habitable \u00e9s sempre del propietari i no \u00e9s v\u00e0lid traslladar l&#8217;obligaci\u00f3 a l&#8217;inquil\u00ed, que nom\u00e9s s&#8217;ha de fer c\u00e0rrec de les petites reparacions per \u00fas.<\/li>\n<li><strong>Acc\u00e9s de l&#8217;arrendador a l\u2019habitatge<\/strong>. Ser\u00e0 nul\u00b7la la cl\u00e0usula per la qual s&#8217;obligui l&#8217;inquil\u00ed a deixar entrar a l&#8217;habitatge l&#8217;arrendador per poder revisar-ne l&#8217;estat.<\/li>\n<\/ul>\n<p>Per tot aquest tipus de problemes, ARAG ha creat <em>ARAG inquilinos<\/em>. L&#8217;asseguran\u00e7a \u00e9s una p\u00f2lissa adaptada als llogaters que lloguen un habitatge. L&#8217;asseguran\u00e7a protegeix els drets i els interessos de l&#8217;inquil\u00ed i el contracte de lloguer d&#8217;habitatge habitual.
