Despr\u00e9s de comunicar els fets a la contractista, aquesta procedeix al seu acomiadament disciplinari.<\/p>\n<p data-start=\"553\" data-end=\"710\">La controv\u00e8rsia litigiosa en aquest assumpte rau a dilucidar si l\u2019acomiadament disciplinari de l\u2019actor s\u2019ha de qualificar com a nul, improcedent o procedent.<\/p>\n<p data-start=\"712\" data-end=\"1315\">Malgrat que en segona inst\u00e0ncia el Tribunal Superior de Just\u00edcia (TSJ) va considerar que la gravaci\u00f3 d\u2019imatges era una prova il\u00b7l\u00edcita, perqu\u00e8 s\u2019havia obtingut vulnerant drets fonamentals, qualificant l\u2019acomiadament disciplinari com a nul i condemnant l\u2019empresa a la readmissi\u00f3 del treballador i al pagament d\u2019una indemnitzaci\u00f3 per danys i perjudicis de 3.000 \u20ac, el Tribunal Suprem considera la proced\u00e8ncia de l\u2019acomiadament i indica que el tractament de les dades obtingudes d\u2019un sistema de videovigil\u00e0ncia, sempre que siguin visibles i conegudes pels empleats, no requereix el seu consentiment expr\u00e9s.<\/p>\n<p data-start=\"1317\" data-end=\"1819\">En el cas en q\u00fcesti\u00f3, les c\u00e0meres s\u2019havien utilitzat per comprovar un fet concret, que va resultar constitutiu d\u2019un il\u00b7l\u00edcit, sobre la base d\u2019una sospita indici\u00e0ria concreta. Per aix\u00f2, el Tribunal Suprem va considerar v\u00e0lida la utilitzaci\u00f3 de les imatges captades per verificar la conducta il\u00b7l\u00edcita comesa pel treballador, en ser una mesura justificada, id\u00f2nia, necess\u00e0ria i proporcionada, basada en sospites indici\u00e0ries suficients d\u2019una conducta irregular del treballador que havia de ser verificada.<\/p>\n<p data-start=\"1821\" data-end=\"2381\">Segons la sent\u00e8ncia, la mesura implementada per l\u2019empresa estava dirigida a constatar la possible il\u00b7licitud de la conducta, fet que es va confirmar mitjan\u00e7ant el visionat de les imatges; la mesura era necess\u00e0ria, ja que no es podia adoptar cap altra de menys invasiva i igualment efica\u00e7 per acreditar la infracci\u00f3 laboral; i tamb\u00e9 es pot considerar proporcionada. La inadmissi\u00f3 d\u2019aquest mitj\u00e0 de prova pel TSJ no comporta que la seva projecci\u00f3 en aquest proc\u00e9s impliqui que l\u2019acomiadament disciplinari realitzat per l\u2019empresa hagi de ser qualificat com a nul.<\/p>\n<p data-start=\"2383\" data-end=\"3216\">El Tribunal Suprem sost\u00e9 que l\u2019apropiaci\u00f3 de diners (STS de 17 de juliol de 1989) o de productes de l\u2019empresa, fins i tot quan es realitza en un centre de la mateixa empresa al qual el treballador no est\u00e0 adscrit i fora de la seva jornada laboral, sempre que es causi un perjudici a l\u2019empresa i tingui algun tipus de vinculaci\u00f3 amb el contracte de treball (STS 699\/2017, de 21 de setembre), constitueixen una especificaci\u00f3 de la transgressi\u00f3 contractual gen\u00e8rica establerta a l\u2019article 54.2.d) de l\u2019Estatut dels Treballadors, consistent en la transgressi\u00f3 de la bona fe contractual, un dels pilars sobre els quals descansa la prestaci\u00f3 laboral, i que provoca un incompliment contractual susceptible de sanci\u00f3 disciplin\u00e0ria per part de l\u2019empresari, amb independ\u00e8ncia del major o menor perjudici econ\u00f2mic que suposin els b\u00e9ns sostrets.<\/p>\n<p data-start=\"3218\" data-end=\"3552\">Aquesta sent\u00e8ncia s\u2019afegeix a la dictada pel Tribunal Suprem el 14 de gener de 2025, en qu\u00e8 tamb\u00e9 es considera v\u00e0lid l\u2019acomiadament d\u2019un treballador basat en proves obtingudes de gravacions de c\u00e0meres visibles i conegudes pels empleats, davant sospites pr\u00e8vies d\u2019irregularitats o anomalies, i utilitzades per comprovar un fet concret.<\/p>\n<p data-start=\"3554\" data-end=\"3946\">Aix\u00ed, el Tribunal Suprem considera que aquesta videovigil\u00e0ncia ha de respectar els principis de proporcionalitat i necessitat, i que davant d\u2019un il\u00b7l\u00edcit flagrant descobert mitjan\u00e7ant una gravaci\u00f3 amb c\u00e0meres visibles i conegudes no \u00e9s necessari sotmetre\u2019s a la necessitat d\u2019informaci\u00f3 individualitzada ni al consentiment previ, fet que permet la seva aplicaci\u00f3 amb finalitats disciplin\u00e0ries.<\/p>\n<p data-start=\"3948\" data-end=\"4008\"><strong data-start=\"3948\" data-end=\"4008\">Qu\u00e8 diu l\u2019Ag\u00e8ncia Espanyola de Protecci\u00f3 de Dades (AEPD)<\/strong><\/p>\n<p data-start=\"4010\" data-end=\"4516\">L\u2019AEPD tamb\u00e9 s\u2019ha pronunciat recentment, en l\u2019expedient EXP202305156, de 14 de novembre de 2025, on indica que \u201cla videovigil\u00e0ncia en el treball no pot ser il\u00b7limitada i ha de subjectar-se als principis de proporcionalitat, necessitat i minimitzaci\u00f3 de dades, assegurant que es respectin els drets fonamentals dels treballadors i es protegeixi la seva dignitat en l\u2019entorn laboral\u201d. Per aquest motiu, sanciona una cl\u00ednica dental que disposava d\u2019un sistema de videogravaci\u00f3 cont\u00ednua en tots els seus espais.<\/p>\n<p data-start=\"4518\" data-end=\"4769\">Pel que fa al consentiment previ, l\u2019AEPD considera que el consentiment dels treballadors no es pot considerar v\u00e0lid, at\u00e8s que existeix una relaci\u00f3 de desequilibri entre les parts que impedeix que aquest consentiment tingui la consideraci\u00f3 de \u201clliure\u201d.<\/p>\n<p data-start=\"4771\" data-end=\"5311\">Un altre l\u00edmit que estableix l\u2019AEPD, en l\u2019expedient EXP202410696, d\u20191 de desembre de 2025, \u00e9s que \u201cla pres\u00e8ncia de c\u00e0meres no implica una llibertat absoluta en la seva instal\u00b7laci\u00f3, ja que hi ha zones reservades que no poden ser objecte de videovigil\u00e0ncia (vestidors, zones de descans, menjadors, etc.)\u201d, tal com recull l\u2019article 89.2 de la Llei org\u00e0nica de protecci\u00f3 de dades personals i garantia dels drets digitals, que regula el dret a la intimitat davant l\u2019\u00fas de dispositius de videovigil\u00e0ncia i de gravaci\u00f3 de sons al lloc de treball.<\/p>\n<p data-start=\"5313\" data-end=\"5759\">En definitiva, podem afirmar que, en aquest assumpte, en qu\u00e8 col\u00b7lisionen dos drets o interessos \u2014els de les persones treballadores per evitar una intromissi\u00f3 il\u00b7leg\u00edtima en la seva privacitat, i els dels ocupadors per verificar el compliment de les obligacions i deures dels treballadors\u2014, s\u2019han de respectar els principis de proporcionalitat i necessitat per utilitzar la videovigil\u00e0ncia amb una finalitat concreta i no de manera generalitzada.<\/p>\n<p data-start=\"5761\" data-end=\"5818\" data-is-last-node=\"\" data-is-only-node=\"\"><strong data-start=\"5761\" data-end=\"5818\" data-is-last-node=\"\">Carlos Solis \u2013 Doctor en Dret i assessor del Col\u00b7legi<\/strong><\/p>\n<\/div>\n<\/div>\n<\/div>\n<\/div>\n<div class=\"z-0 flex min-h-[46px] justify-start\"><\/div>\n<div class=\"mt-3 w-full empty:hidden\">\n<div class=\"text-center\"><\/div>\n<\/div>\n<\/div>\n<\/div>\n<\/article>\n<\/div>\n<div class=\"pointer-events-none h-px w-px absolute bottom-0\" aria-hidden=\"true\" data-edge=\"true\"><\/div>\n<p>[\/vc_column_text][vc_row_inner][vc_column_inner width=&#8221;1\/6&#8243;][\/vc_column_inner][vc_column_inner width=&#8221;1\/6&#8243;][\/vc_column_inner][vc_column_inner width=&#8221;1\/6&#8243;][\/vc_column_inner][vc_column_inner width=&#8221;1\/6&#8243;][\/vc_column_inner][\/vc_row_inner][\/vc_column][vc_column width=&#8221;1\/4&#8243;][stm_spacing lg_spacing=&#8221;50&#8243; md_spacing=&#8221;50&#8243; sm_spacing=&#8221;50&#8243; xs_spacing=&#8221;50&#8243;][vc_column_text]<\/p>\n<h2>\u00daltimes not\u00edcies<\/h2>\n<p>[\/vc_column_text][stm_news loop=&#8221;size:4|order_by:date|order:DESC|post_type:post|categories:8&#8243; posts_per_row=&#8221;2&#8243;][\/vc_column][\/vc_row]<\/p>\n<\/div>","protected":false},"excerpt":{"rendered":"<p>[vc_row][vc_column width=&#8221;3\/4&#8243;][vc_column_text css=&#8221;&#8221;] Es poden usar imatges enregistrades per acomiadar a un treballador?
